Welcome to Land Pirate LLC (“Land Pirate,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of landpirate.com (the “Site”), any mobile app, and all products/services offered (the “Services”). By using the Site or Services, you agree to these Terms. If you don’t agree, stop using them immediately.

We may update these Terms anytime — check back regularly. The “Last updated” date tells you what’s current. Your continued use means you accept changes.

2. Using the Site

Eligibility: Must be 18+ or have parent/guardian permission. No use by kids under 13 (see Privacy Policy).
License: Limited, non-transferable license for personal, non-commercial use only. No scraping, resale, or automated access.
Prohibited Conduct: Don’t misuse the Site, post illegal/harmful content, infringe IP, or disrupt services. We may block or ban violators.

3. Accounts

Optional account for shopping, tracking, and perks. Keep login secure — you’re responsible for all activity.
We may suspend/close accounts for violations or inactivity.

4. Products & Orders

Availability: Items subject to stock. We may limit quantities or cancel orders.
Pricing: USD only. Prices exclude tax/shipping (added at checkout). We may change prices anytime.
Promotions: Offers (e.g., free gifts, discounts) apply automatically where eligible. Subject to change/availability.
Orders: By checking out, you confirm accuracy and authorize payment. We may refuse suspicious orders.

5. Payments Accepted via secure Shopify Payments. See Payment Information. You agree to provide accurate info and pay all charges (including tax/shipping). We may correct pricing errors.

6. Shipping See Shipping Policy:

Processing: 2–3 business days (Mon–Fri)
Delivery: 4–5 business days (USPS/UPS)
Rates: $7.50 flat; free over $150 (contiguous U.S.)

We’re not liable for carrier delays.

7. Returns & Refunds See Returns & Refunds Policy:

30 days from delivery
Customer pays return shipping (except defects/wrong items)
No restocking fees

8. Intellectual Property All Site content (designs, logos, text, images, “Land Pirate” marks) is ours or licensed.

No copying without written permission.
User Content (reviews, photos): You grant us a royalty-free, worldwide license to use/promote. Keep it legal and appropriate.

9. Disclaimers

Site/Services provided “as-is”. No warranties of accuracy, uptime, or fitness for purpose.
Colors/features may vary by device.
We’re not liable for third-party links or user content.

10. Limitation of Liability To the fullest extent allowed by law:

No liability for indirect, incidental, or consequential damages.
Total liability capped at your order amount (or $100 if no order).
Some states limit this — your rights may vary.

11. Indemnification You agree to defend and hold us harmless from claims due to your misuse, breach of Terms, or infringement of third-party rights.

12. Governing Law & Disputes

Law: Rhode Island (without conflict rules).
Resolution:
1. Try informal resolution (email us).
2. If needed, binding arbitration in Newport, RI (AAA Consumer Rules).
3. No class actions.
4. Small claims court allowed.

13. Force Majeure Not liable for delays beyond our control (weather, strikes, etc.).

14. Miscellaneous

These Terms + linked policies = full agreement.
We may assign rights.
Invalid parts don’t void the rest.
No waiver if we don’t enforce.
No partnership/agency created.
